Terms and Conditions

These Terms and Conditions are binding upon the Renter and may be enforced by the Property Owner Erik Foley, or Owner’s designated Agent.

Liability: As the party signing these Terms and Conditions, Renter certifies that they will be held liable for any breach of the terms and conditions, and pay any penalties as specified in this document for breach.

Age: The Renter hereby certifies that s/he is older than 21 years of age in order to rent the Property.

Property: Log Cabin located at 10 porcupine Drive, Campton, NH 03223. The accommodations include two and half bathrooms and three bedrooms with One Queen, One Full, and Seven Twin Beds. The maximum number of occupants is ten.

Occupants: This unit sleeps ten people. If more than ten are to occupy the unit, the Owner must be made aware of the number of people and give written consent, and the Renter will pay an additional $100.00 for each additional person.

Parking: There are three designated parking spots in the area in front of the unit. Please discuss the parking with the Owner prior to arrival, to avoid any confusion. There is an overload parking area at the Waterville Valley Estates Community Center. Extra vehicles can be parked at the Waterville Valley Estates Community Center parking lot.

Pets: Pets shall NOT be allowed without written permission from the Owner, and may be charged a pet deposit at Owner’s discretion.

Hazards: Renter acknowledges the inherent risks of outdoor hazards, including but not limited to: bears, insects, poison ivy, foul weather, and other outdoor risks that could be present at the Property; and agrees to hold Owner harmless from any potential harm by outdoor hazards.

Total Rental Fee: The Total Rental Fee is comprised of the Total Weekly Rent, plus the Cleaning Fee, plus New Hampshire Meals and Rooms tax of 9% of the Total Weekly Rent, and a Damage Deposit of $1,500.00. The Total Rental Fee is set in the digital reservation.

Payment Terms: The Rental Fee and the $1,500 Damage Deposit are due upon receiving and returning signed rental agreement, at which time the key code and House Rules will be emailed to Renter. Should any fees remain unpaid following either the receipt of the signed agreement, or two weeks prior to rental, the Owner reserves the right to cancel this reservation, void any contracts and deduct any applicable fees paid. Reservations are confirmed only these Terms and Conditions are signed, and all payment has been received and cleared.

Damage Deposit: will be returned, provided no damages are documented, after the cleaner’s walk through at the end of the Rental Period. The below are required in order to receive a full Damage Deposit refund:

1. Any accidental damage is reported immediately. 2. No intentional damage is done to the house or its contents. There is no excessive cleaning. 3. All debris, trash and discards are taken to dumpster. 4. Keys are left in lockbox and unit is locked. 5. No linens are lost or damaged. 6. No early check in or late check out without written permission. 7. Kitchen left clean with all dishes clean and put away.

8. Excessive cleaning will be charged at the rate of $50.00 per hour.

Delivery of Payment:

Rental fee must be paid through the booking website.

Returned Checks: If, for any reason, payment made through the booking website is denied, Renter will pay a charge of Thirty-Five Dollars ($35.00) as additional rent and accept any other consequences there might be in making a late payment.

Smoking: This is a NON-SMOKING Rental. Smoking is not allowed inside or outside of the property.

Check in - Check out: Check in time is at or after 4:00 PM and check out time is by 11:00 AM. This is necessary to allow the cleaning company to access and clean the property.

Key: The Key Code will be emailed along with the House Rules after payment is received.

Damages/Fines/Behavior: Renter assures the Owner that the Renter and Guests will observe all conditions and terms of this lease as to maintaining the premises in good order and appearance and will conduct themselves in a manner inoffensive to neighbors. Renter and their Guests shall not disturb, annoy, endanger or inconvenience neighbors nor use the premise for any immoral or unlawful purposes, nor violate any law or ordinance. Renter agrees to leave house and personal property in same condition as when occupancy commenced. Any Renter who violates any term of this agreement shall be immediately denied occupancy and agrees that s/he shall remedy any damages or other expenses which are caused by the Renter or the Renter’s Guests. Renter will be responsible for payment of any damages, fines, or fees incurred by the Renter or any Guests during the Rental Period.

Cancellations: All cancellations must be in writing and are subject to a 10% cancellation fee at any time after contract has been signed and delivered to owner. Cancellations made less than ninety (90) days before the beginning of the Rental Period are subject to entire loss of Rental Amount paid. Owner will make every effort to find another party to rent, and if successful, the entire deposit less the cancellation fee, will be returned.

Ordinances and Statues: Renter shall comply with all statues, ordinances and requirements of all municipal, state and federal authorities now in force, or which may hereafter be in force, or which may be in force, pertaining to the use of the premises.

Attorney’s Fees: The prevailing party in an action brought for the recovery of rent or other moneys due or to become due under this lease or by reason of a breach of any covenant herein contained or for the recovery of the possession of said premises, or to compel the performance of anything agreed to be done herein, or to recover for damages to said property, or to enjoin any act contrary to the provision hereof, shall be awarded all of the costs in connection therewith, including, but not by way of limitation, reasonable attorney’s fees.

Own Risk: Use of the Hot Tub and all amenities are at Renter’s own risk. Renter agrees to follow all precautions and maintenance as outlined in House Rules. Owner is not responsible for circumstances beyond their control.

Authority: Each person signing this agreement represents and warrants that s/he is duly authorized and has legal capacity to execute and deliver this agreement. Each party represents and warrants to the other that the execution and delivery of this agreement and the performance of each party’s obligations have been duly authorized and that agreement is a valid and legal agreement, binding on both parties and enforceable according to its terms.

The Renter explicitly agrees to these Terms and Conditions as of the date approved.
